Ethical Challenges in Design-Build

Art Schwartz is Deputy Executive Director and General Counsel for the National Society of Profession Engineers, for the past 20 years. He serves as staff to the NSPE Board of Ethical Review and is a frequent speaker and author on many topics of interest to professional engineers. Description: One of the barriers to wider use of design-build are concerns of the new ethical dilemmas this delivery method presents. Program attendees will learn how to address typical concerns, review important elements of the Engineer's Code of Ethics which may arise in design-build contracting and identify common ethical problems, such as conflicts of interest and considering who represents the interest of the project owner and the public welfare and safety. Learning objectives: 1. Understand ethical obligations and how they relate to contemporary professional practice in design-build contracting. 2. How to approach and resolve common ethical dilemmas, including where to obtain guidance and resources. 3. Implement ethical obligations in a positive manner to deal with unreasonable client, employer or design-build team requests and expectations.
